Terms of Service

1. Agreement

These Terms govern your use of services provided by Creative Notion ("Creative Notion," "we," "us"), a sole proprietorship based in Tacoma, Washington. By visiting creative-notion-pnw.com, using our client portal at crm.creative-notion-pnw.com, or receiving text messages from us, you agree to these Terms and our Privacy Policy.

If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Services

Creative Notion provides digital marketing services including content strategy, social media management, search engine optimization, reputation management, and business automation consulting. The specific scope, deliverables, pricing, and term of any engagement are governed by the signed service agreement between you and Creative Notion ("Service Agreement"). These Terms apply alongside any Service Agreement; in the event of a conflict, the Service Agreement controls.

3. Client portal

Access to the client portal is provided to active clients of Creative Notion. You are responsible for maintaining the confidentiality of your login credentials and for any activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

We may suspend or terminate portal access for accounts that abuse the platform, share credentials with non-authorized parties, or violate these Terms.

4. Text messaging (SMS) program

Creative Notion operates a text-messaging program for the purpose of communicating with active clients and qualified prospects who have explicitly opted in. By providing your mobile number and consenting to receive text messages from Creative Notion, you agree to the following terms.

4.1 Program purpose

Messages may include account updates, service check-ins, anniversary acknowledgments, reminders about scheduled calls or open invoices, and occasional offers related to services you have not yet engaged.

4.2 Consent

You will only receive text messages if you have explicitly opted in by (a) checking the SMS consent box on our intake form, (b) signing a service agreement containing an SMS consent clause, or (c) providing verbal consent on a recorded call with a Creative Notion representative. Consent is not a condition of any purchase.

4.3 Frequency and cost

Message frequency varies but is typically less than 4 messages per month per recipient. Message and data rates may apply per your mobile carrier's plan. Creative Notion does not charge for the messages themselves. Carriers are not liable for delayed or undelivered messages.

4.4 Opt out and help

You can stop receiving messages at any time by replying STOP to any text from us. You will receive one final confirmation message, after which no further marketing or notification SMS will be sent to that number. Reply HELP for help, or email Sales@CreativeNotionPNW.com.

4.5 Supported carriers

Our SMS program is delivered through Twilio Inc. and supported on major U.S. carriers including AT&T, T-Mobile, Verizon, and others. Service availability may vary; we are not responsible for carrier-side delivery failures.

4.6 Privacy

Your mobile number and SMS opt-in data are handled per our Privacy Policy. We do not sell, rent, share, or trade mobile information with third parties or affiliates for marketing or promotional purposes.

5. Email communication

Active clients receive project-related email as part of normal service delivery. Marketing email (newsletters, announcements not tied to a specific deliverable) is sent only to recipients who have opted in. Every marketing email includes an unsubscribe link; unsubscribing applies to marketing email only and does not affect project email tied to an active engagement.

6. Acceptable use

You agree not to:

• Use our website, portal, or messaging service for any unlawful, abusive, or fraudulent purpose
• Attempt to gain unauthorized access to any portion of our systems
• Use automated tools to scrape, harvest, or interfere with our services
• Impersonate any person or entity, or misrepresent your affiliation
• Upload content that infringes the intellectual property or privacy of others

7. Intellectual property

The marketing site, portal, and all content created by Creative Notion (excluding client-supplied materials and deliverables specifically assigned to a client per a Service Agreement) are the property of Creative Notion. You may not copy, redistribute, or create derivative works without our written permission.

Materials you upload to the portal (brand assets, photos, copy, etc.) remain your property. You grant Creative Notion a limited license to use those materials solely to deliver the services you have engaged us to provide.

8. Disclaimers

Our services are provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee specific marketing outcomes; results depend on many factors outside our control.

9. Limitation of liability

To the maximum extent permitted by law, Creative Notion's total liability for any claim arising out of or related to these Terms, our website, the portal, or our messaging program shall not exceed the amount you have paid Creative Notion in the 12 months preceding the event giving rise to the claim. In no event shall we be liable for indirect, incidental, consequential, or punitive damages.

10. Indemnification

You agree to indemnify and hold Creative Notion harmless from any claim or demand made by a third party arising out of your use of our services, your violation of these Terms, or your violation of any rights of another.

11. Termination

You may stop using our services at any time. We may suspend or terminate access to our website, portal, or messaging program at our discretion if you violate these Terms. Termination of a paid engagement is governed by the Service Agreement.

12. Governing law

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Pierce County, Washington.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email to active clients and reflected in the "Last updated" date at the top of this page. Continued use of our services after a change constitutes acceptance of the updated Terms.
